Agreement

By using this website, submitting a request, booking, or purchasing, you agree to these Terms, our Privacy Policy, Text Message Terms, and Refund & Shipping Policy. If you do not agree, do not use the site. Submitting a request does not create a service agreement; a written service plan or invoice does.

Service expectations

Commercial fly control is a management process, not a one-time cure. We do not promise zero flies, guaranteed elimination, or a guaranteed duration of results. Outcomes depend on property conditions, sanitation, adjacent properties, weather, and season. Scope, frequency, and pricing are set in the written service plan. We do not provide general pest control.

Customer responsibilities

You agree to provide safe, reasonable access to service areas; to tell us about pets, sensitive persons, food-contact surfaces, or hazards; to follow any posted re-entry or preparation instructions; and to maintain sanitation practices we recommend.

Products and applications

Products are applied according to their labels and applicable Texas Department of Agriculture rules. We make no safety or health claims beyond what product labels support.

Scheduling, cancellation, and payment

Invoices are due per the terms stated on the invoice. Past-due balances may incur late fees permitted by law and suspension of service. After-hours service carries an express fee. Cancellation and missed-visit terms are stated in your service plan and our Refund Policy.

Website use

Site content is for general information only and is not professional, health, or legal advice. You may not misuse the site, attempt unauthorized access, scrape it, or submit false information. All content, logos, and the "The Fly Guy" name are our property and may not be used without written permission.

Disclaimer of warranties

The website and its content are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose, except any warranty expressly stated in your written service plan.

Limitation of liability

To the fullest extent permitted by Texas law, Just The Fly Guy is not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or revenue, arising from services or website use. Our total liability for any claim will not exceed the amount you paid us for the service giving rise to the claim during the 12 months before it arose.

Indemnification

You agree to indemnify and hold harmless Just The Fly Guy and its owners and staff from claims arising from your misuse of the site, breach of these Terms, or failure to provide accurate information or safe access.

Disputes

Please contact us first at service@calltheflyguy.com so we can try to resolve any issue informally within 30 days. These Terms are governed by the laws of the State of Texas, with exclusive venue in the state or federal courts of Bexar County, Texas. Claims must be brought individually, not as part of a class action, to the extent permitted by law.

General

If any part of these Terms is unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver. We may update these Terms; continued use after changes means you accept them. Your written service plan controls if it conflicts with these Terms.
